Broad banding of disability....an informative mail

Dear Col Katyal,
Govt of India,Min of Def has issued a letter that the disability element for 100 % disability will be 30% of the reckonable emolument. For a Col it is 30 % 0f 55590 ie16677.For lesser % it will be proportionately reduced. Thus you are now getting 20% of 16677 which is 3336 with DR 119% totaling Rs 7306/-as disability pension.
To remove subjectivity in medical board assessment of disability
V th CPC recommended rounding off of disability,or broad banding.That means all disabilities from 20% to 49% will be rounded off to 50%,from50 to 74 % to 75% and between 75 and 100 to 100%. But govt order give this benefit only to those who were medically boarded out and not to those who retired on completion of tenure.There is a clause in the pension regulation that those who retire with a disability is to be deemed as medically boarded out for the purpose of disability benefit.Quoting this many veteran went to AFT and AFT gave them the benefit.But Govt appealed against these judgements in the Supreme Court.Supreme Court in a land mark judgement No 418 dismissed the Govt appeal allowing broad banding benefit to 816 petitioners.Govt has given the benefit to only those petitioners and not similarly affected veterans. So to get this benefit you have to get a judgement from AFT.
Under broad banding benefit 20% will become50%.You will get Rs 18263/-in place of R 7306/- per month.
