Payment of arrears to JCOs/Other Ranks

2.      Topping the agenda was payment of arrears to the JCOs and OR for the 42 month period from 1.1.2006 to 1.7.2009. It was highlighted that this has become a cause of dissatisfaction among JCO/OR pensioners. It was further highlighted that a  large number of ESMs pensions calculated as per PCDA circular No 547  gives out incorrect pensions drawn by ESM, which has resulted in wrong arrears being paid to JCOs and ORs. The RM assured that these would be released at the earliest. On further urging he agreed to even pay interest for any delay in clearing the arrears.  

 

 

Notification on OROP

  1.  

Periodicity of equalisation of the pension.

The OROP definition as given in the Koshyari Committee report and accepted on the floor of the House is - "One Rank One Pension implies that uniform pension be paid to the Armed Forces Personnel retiring in the same rank with the same length of service irrespective of their date of retirement and any future enhancement in the rates of pension to be automatically passed on to the past pensioners".

5. After the VI Pay Commission the salaries,      and consequently the pensions have been increasing         by 3% every year. This system has also been recommended to be continued by the VII Pay Commission. In pursuance of the spirit of the accepted definition of OROP, the pension equalisation on an annual basis can only meet the requirement. Any periodicity greater than annual will lead to 'one rank many pensions'.  It was also mentioned that the difference between a five-yearly equalisation as given in the Notification and an annual equalisation is within Rs 100 Crore.   

 Fixing of the Benchmark

6. The Notification talks of fixing the benchmark up to which past pensioners of the same rank and  same service are to be brought, based on the mean of minimum  and maximum of the pension scale  in a designated year. This too will lead to a similar anomalous situation of 'one rank many pensions', since the pensions already being received (those above the 'mean') are to be protected.  This will thus result in violating the very definition and spirit of the OROP. Further, in the Press Conference on 5/9/2015 the Hon'ble Defence Minister had mentioned Rs 8,000 to 10,000 Cr as annual OROP expenditure. If instead of the 'mean' a top of the scale is chosen as the benchmark, the expenditure will be covered within that amount.

8.      The RM highlighted the fact that this situation arose mainly because of  the on going agitation at Jantar Mantar. He lamented the fact that his advice not to launch the agitation at this juncture was not heeded. If that had happened, he was sure of having the OROP cleared to the full satisfaction of the veterans. He further assured that he will personaly go to Honorable PM mr. Narender Modi and request him to do the needfull for vaterans. He left no doubt of the Prime Minister's commitment on OROP and was hopeful of getting it resolved ultimately.   

Pre-Mature Retirement (Termed VRS in the Notification)

7. The RM gave assurance that very soon he will issue clarification on which all categories of premature retirees would continue to get the benefit of OROP and who all may not. He although discussed that 2 years after supercession/medical cat the PMR with OROP is being planned after the request by UFESM team and asked the deligation to even convey to vaterans that PMR issue will be resolved .

Judicial Commission 

8.      The delegation requested R M if the major issues/anomalies of OROP as mentioned above could be resolved by the govt without forwarding these to the judicial commission in a gracefull manner since even after the commission the matter finally has to be accepted by the govt only. This would save time and help win greater confidence of the veterans community.  The RM said he would try and promised that he would himself walk up to PM for the matter .
